USTR Announces Addendum To Latest Tariff Announcement

The Office of the United States Trade Representative (USTR) has released an addendum to their recent announcement regarding $200 billion on imports from China. This addendum will also include products that were manufactured due to the transfer of technology, intellectual property and innovation from the United States to China.

The rate of additional duty will initially be set at 10 percent ad valorem. On Jaunary 1, 2019, this rate will increase to 25 percent ad valoremThe 10 percent ad valorem duty rate will apply to products entered for consumption or withdrawn from warehouses for consumption on or after September 24, 2018. The duty rate increase to 25 percent ad valorem will apply to products entered for consumption or withdrawn from warehouses for consumption on or after January 1, 2019.

Public Hearing Process For List 3 Goods

List 3 was enacted on Monday, September 24, 2018. On July 10, 2018, an initial list of 6,031 tariff lines was proposed for future Chinese imports. Changes to this proposed list were made in July and August. The USTR engaged in a public comment period over the course of six weeks, as well as a six-day public hearing period in August. Ultimately, USTR decided to fully or partially remove 297 tariff lines from the original proposed list.

Deadline To Request Exclusions For List 2 Goods

Requests for exclusions from the 25 percent tariffs on goods classified under 284 tariff lines (List 2 Goods) is due by December 18. Any exclusions granted will be retroactive to August 23 and will remain in effect for one year. For more information, click here to read our blog on Section 301 tariffs.
